Stop Efforts to Weaken IP in Brazil

The GIPC has encouraged Brazil to improve legislative measures that provide increased IP protection across all industries and refrain from inappropriately utilizing compulsory licenses in any sector. In 2009, the GIPC partnered with more than a dozen leading Brazil business associations and companies to create the Brazil Intellectual Coalition, based in San Paulo, Brazil.

The coalition aims to fortify Brazilian intellectual capital by encouraging the promotion of a favorable environment for innovation that, in turn, attracts the investment and international partnerships that serve as drivers of economic growth and development. Brazil Intellectual continues to engage new partners from a wide spectrum of industry sectors, including bioenergy, green tech, entertainment, and music. Currently, the coalition is compiling actionable research concerning the Brazilian Congress’ perspectives on IP, which will guide future educational initiatives targeting the political leadership. 

The GIPC is concerned about anti-IP statements by some Brazilian representatives related to the transfer of health care and energy technologies in multilateral bodies. The use of compulsory licenses is not an effective strategy for addressing the issues central to improving the quality of life in Brazil. Recognizing that Brazil is a major economy and a key player in the creation and distribution of environmental technologies and products, IP protections will play a critical role in the economic growth of the country. Without the proper respect for IP, Brazil may experience decreased levels of foreign direct investment, and trade relationships could suffer if the country does not reinforce its system that rewards innovators.
